Spam Policy
Transmission of any material in violation of any Federal, State or local regulation is prohibited within Australia, the United States, Canada, the EU and The United Kingdom.
At DedicatedServers.com.au's, and its officers', discretion we reserve the right to revoke any services at any time for abusive conduct on the system and/or the Internet and its resources as a whole. Sending spam (unsolicited email) from a domain or about a domain is considered abuse of the system and will result in the termination of your account.
DedicatedServers.com.au, and its officers, are deemed the authority to define abusive conduct to the system and definitions may periodically change, or, previous ones be amended. Whilst consistency is aimed for, each case is evaluated on its own merits.
It is well known that spamming (sending junk email) generates a very negative response from most of its recipients. Since it is in everyone's best interest to avoid this, we enforce a strict Anti-Spamming Policy. Sending spam from your domain will result in the termination of your account and, consequently, the bringing forth of all Charges due and payable to the date the service is terminated. Our policy also includes unsolicited email that directly relates to your domain but is sent from another source.
If you are intending to use these tactics for your domain, don't waste your time here, go somewhere else. If you are experiencing abuse regarding a domain that appears to be hosted here, please email abuse@DedicatedServers.com.au.com.au. We are unable to personally answer each complaint, however we investigate all of them and shut down offenders immediately.

AUP - Acceptable Use Poilcy
As a provider of Internet access, web site hosting, co-location and other Internet-related services, DedicatedServers.com.au Pty Ltd offers its customers, and their customers and users, the means to acquire and disseminate a wealth of public, private, commercial, and non-commercial information. DedicatedServers.com.au Pty Ltd respects that the Internet provides a forum for free and open discussion and dissemination of information, however, when there are competing interests at issue, DedicatedServers.com.au Pty Ltd reserves the right to take certain preventative or corrective actions. In order to protect these competing interests, DedicatedServers.com.au Pty Ltd has developed an Acceptable Use Policy ("AUP"), which supplements and explains certain terms of each customer's respective service agreement and is intended as a guide to the customer's rights and obligations when utilising DedicatedServers.com.au Pty Ltd’s services. This AUP will be revised from time to time. A customer's use of DedicatedServers.com.au Pty Ltd's services after changes to the AUP are posted on DedicatedServers.com.au Pty Ltd’s web site, www.dedicatedservers.com.au, will constitute the customer's acceptance of any new or additional terms of the AUP that result from those changes.
One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use the Internet, both in the information they acquire and in the information they disseminate to others. When customers disseminate information through the Internet, they also must keep in mind that DedicatedServers.com.au Pty Ltd does not review, edit, censor, or take responsibility for any information its customers may create and/or publish. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation, and other harmful speech. Also, because the information they create is carried over DedicatedServers.com.au Pty Ltd’s network and may reach a large number of people, including both customers and non-customers of Webhost DSA Pty Ltd, customers' postings to the Internet may affect other customers and may harm DedicatedServers.com.au Pty Ltd’s goodwill, business reputation, and operations. For these reasons, customers violate DedicatedServers.com.au Pty Ltd’s Acceptable Use Policy and the service agreement when they, their customers, affiliates, or subsidiaries engage in the following prohibited activities:
* Spamming - Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming"). It is not only harmful because of its negative impact on consumer attitudes toward DedicatedServers.com.au Pty Ltd, but also because it can overload DedicatedServers.com.au Pty Ltd’s network and disrupt service to DedicatedServers.com.au Pty Ltd customers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, DedicatedServers.com.au Pty Ltd has and retains the discretion to determine from all of the evidence whether the email recipients were from an "opt-in" email list.
* Intellectual Property Violations - Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities. Also, engaging in activity that violates privacy, publicity, or other personal rights of others. DedicatedServers.com.au Pty Ltd is required by law to remove or block access to customer content upon receipt of a proper notice of copyright infringement. It is also DedicatedServers.com.au Pty Ltd’s policy to terminate the privileges of customers who commit repeat violations of copyright laws.
* Obscene Speech or Materials - Using DedicatedServers.com.au Pty Ltd’s network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material is strictly forbidden. DedicatedServers.com.au Pty Ltd is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on, or being transmitted through, DedicatedServers.com.au Pty Ltd’s network. Furthermore, DedicatedServers.com.au Pty Ltd will co-operate with all appropriate agencies/authorities in the investigation, cessation, and prosecution of such individuals, companies and/or corporations suspected to be involved.
* Defamatory or Abusive Language - Using DedicatedServers.com.au Pty Ltd’s network as a means to transmit or post defamatory, harassing, abusive, or threatening language.
* Forging of Headers - Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.
* Illegal or Unauthorised Access to Other Computers or Networks - Accessing illegally or without authorisation computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).
* Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities - Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail-bombing, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment.
* Facilitating a Violation of this AUP - Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail-bombing, denial of service attacks, and piracy of software.
* Export Control Violations - Exporting encryption software over the Internet or otherwise, to points outside the United States.
* Usenet Groups - DedicatedServers.com.au Pty Ltd reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup violates the AUP.
* Other Illegal Activities - Engaging in activities that are determined to be illegal, including advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, and pirating software.
* Other Activities - Engaging in activities, whether lawful or unlawful, that DedicatedServers.com.au Pty Ltd determines to be harmful to its customers, operations, reputation, goodwill, or customer relations.
As we have previously pointed out, the responsibility for avoiding the harmful activities just described rests primarily with the customer. DedicatedServers.com.au Pty Ltd will not, as an ordinary practice, monitor the communications of its customers to ensure that they comply with DedicatedServers.com.au Pty Ltd’s Acceptable Use Policy or applicable law. When DedicatedServers.com.au Pty Ltd becomes aware of harmful activities, however, it may take any action to stop the harmful activity, including but not limited to, removing information, shutting down a web site, implementing screening software designed to block offending transmissions, denying access to the Internet, or take any other action it deems appropriate. Note, this does not automatically qualify a customer for suspension of accrued costs. Billing only ceases once the customer has returned to DedicatedServers.com.au Pty Ltd a completed cancellation notice. DedicatedServers.com.au Pty Ltd reserves the right to recover costs in arrears from customers whose services are suspended for any reason.
DedicatedServers.com.au Pty Ltd also is aware that many of its customers are, themselves, providers of Internet services, and that information reaching DedicatedServers.com.au Pty Ltd’s facilities from those customers may have originated from a customer of the customer, or, from another third-party. DedicatedServers.com.au Pty Ltd does expect its customers who offer Internet services to monitor or censor transmissions or web sites created by customers of its customers. DedicatedServers.com.au Pty Ltd has the right to directly take action against a customer of a customer. Also, DedicatedServers.com.au Pty Ltd may take action against the DedicatedServers.com.au Pty Ltd customer because of activities of a customer of the customer, even though the action may or may not affect other customers of the customer. Similarly, DedicatedServers.com.au Pty Ltd anticipates that customers who offer Internet services will co-operate with DedicatedServers.com.au Pty Ltd in any corrective or preventive action that DedicatedServers.com.au Pty Ltd deems necessary. Failure to co-operate with such corrective or preventive measures is a violation of DedicatedServers.com.au Pty Ltd’s Acceptable Use Policy.
DedicatedServers.com.au Pty Ltd also is concerned with the privacy of on-line communications and web sites. In general, the Internet is neither more nor less secure than other means of communication, including mail, facsimile, and voice telephone service, all of which can be intercepted and otherwise compromised. As a matter of prudence, however, DedicatedServers.com.au Pty Ltd urges its customers to assume that all of their on-line communications are not secure. DedicatedServers.com.au Pty Ltd cannot take any responsibility for the security of information transmitted over DedicatedServers.com.au Pty Ltd’s facilities.
DedicatedServers.com.au Pty Ltd will not intentionally monitor private electronic mail messages sent, or received, by its customers unless required to do so by law, governmental authority, or when public safety is at stake. DedicatedServers.com.au Pty Ltd may, however, monitor its service electronically to determine that its facilities are operating satisfactorily. Also, DedicatedServers.com.au Pty Ltd may disclose information, including but not limited to, information concerning a customer, a transmission made using our network, or a web site, in order to comply with a court order, subpoena, summons, discovery request, warrant, statute, regulation, or governmental request. DedicatedServers.com.au Pty Ltd assumes no obligation to inform the customer that customer information has been provided and in some cases may be prohibited by law from giving such notice. Finally, DedicatedServers.com.au Pty Ltd may disclose customer information or information transmitted over its network where necessary to protect DedicatedServers.com.au Pty Ltd and others from harm, or where such disclosure is necessary to the proper operation of the system.
DedicatedServers.com.au Pty Ltd expects that its customers who provide Internet services to others will comply fully with all applicable laws concerning the privacy of on-line communications. A customer's failure to comply with those laws will violate DedicatedServers.com.au Pty Ltd’s Acceptable Use Policy. Finally, DedicatedServers.com.au Pty Ltd wishes to emphasise that in signing the service agreement, customers indemnify DedicatedServers.com.au Pty Ltd for any violation of the service agreement, law, or DedicatedServers.com.au Pty Ltd’s Acceptable Use Policy, that results in loss to DedicatedServers.com.au Pty Ltd or the bringing of any claim against DedicatedServers.com.au Pty Ltd by any third-party. This means that if DedicatedServers.com.au Pty Ltd is sued because of a customer's, or customer of a customer’s activity, the customer will pay any damages awarded against DedicatedServers.com.au Pty Ltd, plus costs and reasonable legal fees.
We hope this AUP is helpful in clarifying the obligations of Internet users, including DedicatedServers.com.au Pty Ltd and its customers, as responsible members of the Internet. Any complaints about a customer's violation of this AUP should be sent to DedicatedServers.com.au Pty Ltd to info@ DedicatedServers.com.au.
SLA's - Service Level Agreements
DedicatedServers.com.au, like most companies in the hosting business, have had to accept the majority of server customers prefer a low cost service. As a consequence of meeting price points that the market dictates many "standard features" now come available as "premium services”. The removal of Service Level Agreements is one area that offers customers the ability to save by dispensing with penalty guarantees.
We understand that downtime can lose you customers and lose us your business, but we offer no uptime guarantees. Our current network uptime is over 99.9%. We also fully support any hardware and networking issues you may have on rental or VPS servers but only network issues on collocated servers.
For premium services we have the capacity to offer specific SLA's guarantees on an individual basis by negotiation and this charged at accordingly. Typically for a 100% uptime guarantee, including penalty clauses if not met, you will receive a dedicated technical account manager with 24 X 7 phone access. We charge a 400% loading on all services covered under the SLA (per month) and require a min 12 month contract from the customer. The minimum contract value must exceed $1000 per month. Refund Policy
DedicatedServers.com.au is proud to offer an unconditional 14-day money back guarantee on all of our shared hosting plans. With regard containers and servers no refund will be given on initial set-up fees, and all ancilliary purchases of consumables, including but not limited to, domain names, SSL certificates and support packages. All other refund requests will be judged on their merit if and when necessary.
Please note, we do not normally give refunds if you:
• simply change your mind, or
• make a wrong decision.
You can choose a refund where goods:
• are faulty, or
• do not do what they are supposed to.
Or, you can choose a credit where goods:
• have been wrongly specified for a purpose described by the Customer, or
• are different from a sample shown to the Customer to the extent that their specificity to purpose is compromised

Service Payment
All customers must submit either a Credit Card Authority form or Direct Debit Authority form once an order has been received, before service commences. This will be held on file for payments. Credit card and bank account details must be kept current at all times.
Credit Card
Dedicatedservers.com.au retains the right to charge a credit card admin fee on all payments made to Dedicatedservers.com.au by credit card (including debit cards). This fee is currently 2% for Visa & MasterCard, or, 4% for American Express. This fee will be added to Invoices at time of payment.
Furthermore, to change your credit card on file a new Credit Card Authority must be submitted. To change payment method to credit card from direct debit a Direct Debit Authority must be supplied.
You may request the form by lodging a support ticket requesting this form. Please allow 5 working days for change of payment method to be processed.
Direct Debit
By using our direct debit payment method customer agrees to pay all charges associated with this method. This method of payment attracts no administration fees. However, if a debit fails, fees imposed by out third party payment gateway may be passed on to the end customer.
To change payment method to direct debit from credit card a Direct Debit Authority must be supplied. Similarly, to change direct debit details a new Direct Debit Authority form must be submitted.
You may request the form by lodging a support ticket requesting this form. Please allow 5 working days for change of payment method to be processed.
Chargeback Abuse Policy
Purchases will appear on your credit/debit card statement as DedicatedServers.com.au Pty Ltd. You agree not to file a credit card or debit card chargeback with regard to any purchase and instead abide by the dispute resolution procedures outlined in our Terms and Conditions. In the event that you breach this agreement and file an unwarranted chargeback, upon a resolution in our favor of the chargeback by either the credit card issuing bank, the credit card processor or by VISA or MASTERCARD, you agree to reimburse us for any costs incurred in researching and responding to such chargeback, including without limitation, our actual costs paid to the credit card processor or our banks, other third parties, and the reasonable value of the time of our employees and owners spent on the matter, as determined in our discretion in good faith. You further agree that all dispute resolution procedures below will be deemed waived by you, and that these amounts will be added to the original amount of the order, and that this total amount will then be immediately due and payable. If your chargeback is upheld, you agree to pay all of the same costs, in addition to the original purchase price, but we will use the dispute resolution procedures below to confirm and collect such amounts.
In the event that a chargeback is placed or threatened on a purchase, we also reserve the right to report the incident for inclusion in chargeback abuser database(s) of our choosing and in our sole discretion. The information reported will include name, email address, order date, order amount, IP address, full address, and phone number. Being listed on such databases may make it more difficult or even impossible for you to use (any of) your credit card(s) on future purchases with us or other merchants. Chargeback abusers wishing to be removed from the database shall make payment to us for any outstanding amount owed to us + au$55 for processing and handling by wire transfer or such other means as we may require.
